WRC Dismisses Ryanair Discrimination Claim Over “Abuse of Process”
A recent Workplace Relations Commission (WRC) ruling has attracted attention after a €170,000 discrimination claim against Ryanair was dismissed on the grounds of “abuse of process.” The case highlights the risks of relying on AI-generated content in formal legal submissions and underscores the importance of procedural integrity in employment disputes.
Flight attendant Fernando Oliveira brought a claim against Ryanair under the Employment Equality Act 1998, alleging discrimination on the basis of race and family status.
During the proceedings, the WRC adjudicator identified serious issues within the complainant’s written submissions, many of which included legal references that were irrelevant, misquoted or entirely non-existent. Ryanair’s legal representatives argued that sections of these submissions appeared to have been created using artificial intelligence (AI) tools, producing numerous “phantom” citations.
The adjudicator concluded that the claimant’s actions had wasted considerable time and that the introduction of new allegations late in the process further undermined the fairness and integrity of the hearing. As a result, the case was dismissed.
