Most of the cases in the Labour Court or WRC occur because the Employer did not apply the correct fair procedures which can lead to the employee having a plausible reason when entering a legal appeal. Moreover, it usually happens because there is lack of understanding how the employment law works and what procedure must be applied in these circumstances.

- Ensure that the management team fully understand the legislation and its amendments.
- Communicate any changes to employees, and how it may affect the company and the themselves.

Wrongful termination of employment
Dealing with a dismissal can be very overwhelming, and sometimes Employers/ Managers do not think about the consequences of dismissing an employee without applying fair procedures. As a result, many employees enter appeals at the labour court. Where an Employer wants to dismiss an employee, the fair procedures must be applied to avoid further legal requests.

Not implementing a Healthy and Safety policy
It is a frequent HR issue, as businesses sometimes fails on creating H&S policies and procedures. Your company is required to have updated records of Health & Safety. The Welfare at Work Act 2005 states that business must have a valid and relevant health and safety procedure and document signed by the Employer. As a result, tt is proof that the Employer will safeguard the employee and all the other people involved with the business.
How to manage it:
- Create a Health and Safety Policy and Procedures
- Carry out a risk assessment
- Implement Health and Safety Statement
- Review the policies and procedures periodically, to certify that the correct amendments have been made.
