It is an offence to send or read a text messages (including SMS, MMS or email) while operating a mechanically propelled vehicle in a public place if sending or reading the text requires the phone to be physically touched.
This new legislation makes operating a mobile phone, even if it is in a cradle, an offence. This offence is punishable on conviction with a fine of up to €1,000 for the first offence.
